US Judge Flags Potential Contempt Over Migrant Deportations to South Sudan

A federal judge warns the Trump administration it may face legal repercussions for deporting migrants to South Sudan in violation of a court order.


Judge Brian Murphy indicates that deportations conducted by the Trump administration may breach his recent order against sending migrants to third countries without sufficient legal recourse. A federal judge has raised significant concerns regarding the Trump administration's deportation efforts, stating that recent removals of migrants to South Sudan may contravene an existing court order. Judge Brian Murphy issued this warning based on an emergency request from immigration attorneys, who alerted the court that a flight with deported individuals had recently arrived in South Sudan, potentially violating a ruling preventing the US government from deporting migrants to third countries without providing them a "meaningful opportunity" to contest their deportation.

In court proceedings, Judge Murphy, appointed by President Biden, highlighted the gravity of the situation, suggesting that the actions of the Trump administration could be deemed contempt of court. Immigration attorneys from the National Immigration Litigation Alliance urgently sought intervention, citing individuals from Myanmar and Vietnam among those reported as deported.

The Department of Justice responded to the court's inquiry, claiming that not all deportations were to South Sudan, with one Burmese migrant being sent back to Myanmar. However, details about the second deported individual from Vietnam remain undisclosed. Attorney Elianis Perez indicated that the Vietnamese individual had a serious criminal record, which adds complexity to the deportation case.

While Judge Murphy decided against ordering the return flight to the US, he mandated that the deported individuals remain under government custody, ensuring humane treatment until a scheduled hearing. This echoes a broader legal conflict surrounding the Trump administration's immigration policies, notably amidst reports of intended deportations to regions like Libya, which would violate the judge's preliminary injunction.

As international concern grows, advocates for the deported individuals—some of whom are allegedly placed at risk due to the instability of South Sudan—are fervently urging for legal action.
