Mr. Ábrego García was deported in March during a heightened immigration crackdown by the Trump administration. Although officials acknowledged that his deportation was a mistake, they initially resisted bringing him back. Upon his return to the US, he was charged with human smuggling in Tennessee.
A ruling by Judge Barbara Holmes on Sunday indicated that the government had not sufficiently proven that Mr. Ábrego García posed a risk to minors, would flee, or obstruct justice, thus allowing for his release. However, she acknowledged that immigration officials could still detain him.
Department of Homeland Security spokesperson Tricia McLaughlin labelled him as a “dangerous criminal illegal alien” and reiterated the government's position that he will be detained indefinitely, regardless of the court’s ruling.
