A federal court ruling has granted the release of Rumeysa Ozturk, a 30-year-old Turkish student at Tufts University, who was detained in Louisiana after being arrested by US immigration officials in Massachusetts. The ruling came during a virtual court hearing led by US District Judge William Sessions, who criticized the government’s handling of the case, highlighting the chilling effect on free speech for non-citizens in the country.
Ozturk had gained attention after co-authoring a critical opinion piece about Israel's actions in the ongoing conflict, an article that came under scrutiny following the Biden administration's intensified efforts against what it described as antisemitism at US educational institutions. The Department of Homeland Security accused her of being involved in activities that allegedly supported Hamas.
Despite the government's claims, no witnesses were presented during the court proceedings to substantiate the allegations against her. Judge Sessions pointed out the weak foundation of the government's accusations, stating, “That literally is the case. There is no evidence that she has engaged in violence or advocated violence.”
The controversy surrounding her arrest – captured on video showing masked officers detaining her after a Ramadan celebration – sparked protests across the nation. Her release was ordered without any travel limitations, allowing her to return to Vermont or Massachusetts, where her university is located.
The ACLU, representing Ozturk, expressed satisfaction with the ruling, emphasizing the importance of First Amendment rights in their statement, which affirmed that "no one should be imprisoned by the government for expressing their beliefs." As the government prepares for her release, they have been instructed to notify the judge.
