Harvey Weinstein’s retrial for rape and sexual abuse began in New York, following a previous conviction that was overturned by the court. During the opening statements, prosecutors accused Weinstein of exploiting his Hollywood power to sexually abuse and harass multiple women. Assistant District Attorney Shannon Lucey stated, "The defendant wanted their bodies, and the more they resisted, the more forceful he got."
This marks Weinstein's third trial in five years, as he stands accused of sexually abusing a former television production assistant, an aspiring actress, and a model. Weinstein has pleaded not guilty, and his attorney, Arthur Aidala, argued that the prosecution’s case is fundamentally weak. Aidala claimed they would ask the jury to comprehend inconsistencies in the witnesses' accounts.
Weinstein's earlier sex crimes conviction was thrown out by a court of appeals last April, which led to his indictment on additional sexual assault charges in September. During this retrial, the jury consists of 12 members, including seven women and five men, who will evaluate the evidence against Weinstein.
In the previous ruling, the appeals court determined that Weinstein, now 73, did not receive a fair trial because the judge permitted testimonies regarding women’s allegations that were outside of the charges he faced. Prior to his overturned conviction, Weinstein was serving a 23-year prison sentence after being found guilty in 2020. In addition to this, he was sentenced to 16 years for rape in a separate trial held in California in 2022.
The retrial is also expected to include testimonies from two women who had previously testified against him during the 2020 trial, along with an unnamed woman alleging that Weinstein forcibly performed oral sex on her in a Manhattan hotel in 2006.
Weinstein's health has been a concern; he suffers from several medical conditions, including cancer and diabetes. He recently underwent heart surgery and is currently housed in a secure medical unit. His legal team successfully sought to keep him at Bellevue hospital when not in court, as they cited poor medical treatment received at the Rikers Island facility.
Weinstein has faced accusations from over 100 women regarding various sexual misconduct, assault, and rape allegations. He is anticipated to spend the remainder of his life in prison, owing to his existing convictions. The #MeToo movement gained momentum as a result of the testimonies from his accusers, shining a light on the issue of sexual abuse by powerful men in the entertainment industry.
Weinstein was once a prominent figure in Hollywood, having co-founded Miramax and produced critically acclaimed films like Shakespeare in Love and Pulp Fiction, which achieved significant Oscar recognition. He also faces civil lawsuits, including a $19 million settlement reached in 2020 with women who accused him of sexual harassment and assault.
