Elizabeth Holmes' Appeal Denied: A Setback for Theranos Founder
Elizabeth Holmes, former CEO of Theranos, faces a significant legal blow as her appeal against fraud conviction is rejected.
Theranos founder Elizabeth Holmes has faced a major setback as the Ninth Circuit Court of Appeals has denied her appeal against her fraud conviction. Holmes, who was once heralded as a tech visionary, was sentenced to over 11 years in prison for defrauding investors regarding the efficacy of her company’s blood-testing technology.
In her appeal, Holmes contested the admission of specific trial evidence and testimony, asserting that remarks from her ex-partner, Ramesh "Sunny" Balwani, regarding his responsibility for the company’s financial operations should have been included. Balwani himself is serving a 12-year prison sentence for his role in the fraud.
The appeals court, however, dismissed her claims, with Judge Jacqueline H. Nguyen writing that the promises made by Theranos regarding its capabilities were deceptive, describing them as "nothing more than a mirage." The judge characterized the assertions made by Holmes and Balwani about the company’s success as "half-truths and outright lies."
Holmes was found guilty in 2022 of conspiracy and wire fraud, where she misled investors about the financial stability and technological effectiveness of Theranos. Balwani, tried separately, also faced a conviction related to defrauding patients. Both Holmes and Balwani appealed a court order commanding them to pay $452 million in restitution to their victims, but this too was upheld by the appeals court.
At its peak, Theranos was valued at an astonishing $9 billion; however, investigative reports that emerged in late 2015 shed light on internal issues and the limitations of its technology. Following an extensive two-and-a-half-year probe, Holmes and Balwani were indicted, leading to their convictions. Elizabeth Holmes has been incarcerated in Texas since 2023, serving as a cautionary tale of ambition gone awry in Silicon Valley.
