What Went Wrong?
Erin Patterson, who is currently incarcerated in Victoria, attended her appeal hearing via a video link on Wednesday. Her lawyers have moved to overturn a life sentence that was handed down after she allegedly killed three of her relatives and attempted to kill a fourth by serving them a beef Wellington laced with the deadly death‑cap mushroom.
The crux of the defence’s appeal is a so‑called “catastrophic” hotel mix‑up. The jury in Patterson’s original trial was housed in the same hotel that also accommodated several prosecutors and a key witness. The lawyers argue that this arrangement created a conflict of interest and potentially compromised the impartiality of the jury.
In addition to the hotel issue, Patterson’s counsel says the trial was damaged by speculative evidence being given undue weight and by rightful evidence being wrongfully excluded from the record.
According to the BBC’s Australia correspondent, Katy Watson, the court will consider whether these procedural errors might have led to an injustice, risking a life sentence that is possibly unwarranted.
