California is taking a bold step to protect the identities of immigrant street vendors from potential federal immigration agents. A new law, signed by Governor Gavin Newsom, aims to ensure privacy for these vendors who often sell food, flowers, and various merchandise on sidewalks throughout the state.
This legislation, effective January 1, 2022, prohibits local governments from asking street vendors about their immigration status or requiring them to provide personal information without a judicial subpoena. The intent is to mitigate the risks these vendors face, as their work in public spaces makes them more visible and thus more vulnerable to immigration enforcement actions.
The passage of this law is part of a broader trend in Democratic-led states that are enacting measures to protect immigrant communities, contrasting sharply with Republican-led states that are mandating local law enforcement cooperation with federal immigration authorities.
Jessica Vaughan, director of policy studies at the Center for Immigration Studies, noted the increasing polarization on immigration issues across the country. While some states cooperate closely with federal immigration enforcement, others are actively seeking to thwart such actions.
Recent analyses show that more than 100 immigration-related bills were passed this year across various states, highlighting the division in legislative responses to immigration policy.
California’s Initiatives to Safeguard Immigrants
This legislation is just one part of California's broader initiative to protect immigrant rights. Other laws signed by Newsom include protections for student privacy in schools and safeguarding patient information in healthcare settings. These measures aim to foster safe environments for immigrants amid heightened fears of deportation.

In contrast, states like Texas, Florida, and Arkansas are implementing measures to support federal immigration efforts, including training local law enforcement to assist Immigration and Customs Enforcement (ICE). The divide in state responses underscores the contentious national debate over immigration policy.
